Who we are

Fizzy Jar is run by Lightfunnels Digital Ltd, a company registered in England and Wales (company number 17470268). Registered office: 24-26 Arcadia Avenue Fin009, London N3 2JU, United Kingdom. Questions about an order, a refund or anything else: hello@fizzyjar.com.

Who you buy from

When a product page says payments are by Whop, you buy from the creator through our checkout: Whop processes the payment as the merchant of record for it, and the creator's share goes straight into their own Whop account. When it says "You buy from Fizzy Jar", you buy from us, and the creator's share goes straight to their own Stripe account. Otherwise you buy from the creator, through their own Stripe account, and we provide the shop.

Your account

Buyers don't need an account: an email address is enough. To sell, you need an account and must be 18 or over. Give us accurate details, keep your sign-in safe, and tell us at hello@fizzyjar.com if you think someone else is using your account. Sellers are responsible for everything in their store.

What you can do with what you buy

You get a personal licence to download and use what you buy. You can't share, resell or publish the files unless the creator's product page says you can. Some creators print your email on their PDFs to discourage sharing. Download links expire on purpose, and you can always get a new one from your receipt.

Refunds

You can ask for a refund within 30 days of buying, for any reason. That goes further than the 14 days UK and EU law gives you to cancel. Your legal rights stay as well: if a product is faulty or not as described, you're entitled to a fix, a replacement or your money back, even after the 30 days.

How refunds work

Selling on Fizzy Jar

Sellers accept these terms and the seller terms when they set up "Get paid". Sellers must describe their products honestly, deliver what they describe, and help buyers who have a problem. On sales paid through Whop, the seller's share (the price minus our fee and the card processing fee) goes straight into the seller's own Whop account, and the seller withdraws it from there. On sales where the buyer buys from Fizzy Jar, we buy the right to resell the product and sell it in our own name. At each of those sales, the seller's share (the price minus our fee) goes straight to the seller's Stripe account, and Stripe pays it out.

Fees and when sellers are paid

Our fees are on the Sell page and on each seller's Your Money page. We email sellers at least 30 days before a fee goes up. On sales paid through Whop, the card processing fee also comes out of the seller's share, and each sale's money is ready to withdraw from the seller's Whop account 1 to 4 business days after the sale. On sales where the buyer buys from Fizzy Jar, Stripe pays the seller every Friday for sales at least 10 days old. For sellers with their own Stripe, the money lands in their Stripe account when the buyer pays.

Payments for sellers, by Whop

Payments on Fizzy Jar are processed by Whop, our payments partner. Whop is the merchant of record for each payment it processes, and each seller paid through Whop has their own payout account with Whop. Sellers paid through Whop accept Whop's Terms of Service as well, as Whop may change them from time to time, and Whop checks who they are before their first paid sale. So that Fizzy Jar can offer payments through Whop, you agree to give Fizzy Jar accurate and complete information about you and your business, and you allow Fizzy Jar to share it, and information about your transactions on Fizzy Jar, with Whop. This section applies to sellers paid through Whop. The next one applies where payments go through Stripe instead.

Whop's Terms of Service

Payments for sellers, by Stripe

Where Whop isn't used, payment processing services for sellers on Fizzy Jar are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (stripe.com/legal/ssa), together the "Stripe Services Agreement". By agreeing to these terms or continuing to sell on Fizzy Jar, you agree to be bound by the Stripe Services Agreement, as Stripe may change it from time to time. So that Fizzy Jar can offer payment processing through Stripe, you agree to give Fizzy Jar accurate and complete information about you and your business, and you allow Fizzy Jar to share it, and information about your transactions on Fizzy Jar, with Stripe.

Prices, currency and tax

Prices are in the seller's currency, and checkout shows the final price, including any tax, before you pay. If your card is in another currency, your bank converts it and may charge a fee. When you buy from Fizzy Jar through Stripe, we collect and pay the VAT or sales tax on the sale. When you pay through Whop, Whop processes the payment as the merchant of record; the seller remains responsible for any VAT or sales tax due on the sale unless Whop collects it for them. When a seller uses their own Stripe, the seller is responsible for the tax on their sales. Sellers are responsible for tax on their own income.

Where sellers can be based

Paid products can be sold by sellers in the countries where Whop pays sellers: about 177, including Turkey, Morocco and the UAE, but not Nigeria, Lebanon or countries under sanctions. Where payments go through Stripe instead, paid products can be sold by sellers in the US, the UK, the EEA, Canada and Switzerland, and by sellers with their own Stripe account wherever Stripe offers one. Sellers elsewhere can publish free products. Sellers in Cuba, Iran, North Korea, Syria, Russia and Belarus can't sell on Fizzy Jar.

What can be sold

What isn't allowed, and what we do about it, is on the acceptable use page.

Acceptable use

Who owns what

Sellers keep all rights to their products. By listing a product, a seller lets us store it, deliver it to buyers, and show its title, description and images on Fizzy Jar, including on the marketplace and in link previews. We own Fizzy Jar itself: the site, the software and our name.

Closing an account

Sellers can close their store at any time by emailing hello@fizzyjar.com. Buyers keep what they bought: before a store's files are removed, we email its buyers so they can download them. We can suspend or close an account that breaks these terms or the acceptable use rules, puts buyers or other sellers at risk, or has unusually high refunds or chargebacks. We tell the seller why, unless the law or a fraud investigation stops us. Refunds owed to buyers are still paid.

What we're responsible for

We run Fizzy Jar with reasonable care and skill, but we can't promise it will always be available or free of errors. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to limit, and nothing here affects your rights as a consumer. We aren't liable for losses we couldn't reasonably have foreseen. Sellers use Fizzy Jar for business: our total liability to a seller in any 12 months is limited to the fees they paid us in that time, and sellers are responsible to us for their products and what they say about them.

Law and disputes

If something goes wrong, email hello@fizzyjar.com first: most problems are solved faster that way. These terms are governed by the law of England and Wales. If you're a consumer, you can bring a claim in the courts where you live, and you keep any protection the law of your country gives you.

Changes to these terms

We may update these terms as Fizzy Jar changes. We email sellers at least 30 days before a change that affects them takes effect, and the date of the latest version is at the top of this page. A purchase is always covered by the terms in place when it was made.
